Terms of Service

Please read these Terms carefully before using AutomateNexus Voice. They govern your access to and use of automatenexusvoice.com and the Service.
1. Acceptance of Terms
These Terms of Service ("Terms") form a binding agreement between you (the "Customer") and AutomateNexus Voice ("we," "us," or "our") and govern your access to and use of automatenexusvoice.com and our AI voice receptionist service (the "Service").
By creating an account or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. These Terms are a standard template and do not constitute legal advice.
2. Description of Service
AutomateNexus Voice provides an AI-powered voice receptionist that answers and places calls, qualifies leads, books appointments, and syncs information with your connected tools. Features, capabilities, and availability may change over time as we improve the Service.
3. Accounts & Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of your account information, for maintaining the confidentiality of your credentials, and for all activity that occurs under your account.
Notify us promptly of any unauthorized use of your account or any other breach of security.
4. Plans & Subscriptions
The Service is offered on paid monthly subscription plans. Plan features, usage limits, and pricing are described on our pricing page and may be updated from time to time.
Subscriptions are billed monthly in advance and continue until cancelled. You may cancel at any time, and cancellation takes effect at the end of the current billing period.
5. Subscriptions, Billing & Cancellation
Paid plans are billed in advance on a recurring basis (for example, monthly or annually) according to the plan you select. Fees are non-refundable except where required by law or expressly stated otherwise.
Your subscription renews automatically until cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Usage-based charges, telephony fees, and applicable taxes may apply in addition to your plan fee.
6. Acceptable Use
You agree to use the Service lawfully and not to misuse it. You may not, and may not permit others to:
- Use the Service for illegal robocalling, unsolicited telemarketing, or any activity that violates the Telephone Consumer Protection Act (TCPA), Do-Not-Call rules, or other applicable calling and messaging laws.
- Place or receive calls without obtaining any consent required by law, or fail to provide legally required disclosures.
- Transmit unlawful, fraudulent, harassing, deceptive, or harmful content.
- Attempt to reverse engineer, disrupt, overload, or gain unauthorized access to the Service or its infrastructure.
- Use the Service to build a competing product or to violate the rights of any third party.
7. Customer Data & Ownership
As between you and us, you own the data you submit and the call recordings, transcripts, and lead data generated for your account (“Customer Data”). You grant us a limited license to process Customer Data solely to provide, secure, and improve the Service, and as described in our Privacy Policy.
You are responsible for the legality of your Customer Data and for having the rights and consents needed to provide it to us.
8. Service Availability & SLA
We target 99.9% monthly uptime for the Service. Despite our efforts, the Service is provided on an “as available” basis, and we do not guarantee that it will be uninterrupted, timely, secure, or error-free.
We may perform scheduled maintenance and may modify, suspend, or discontinue parts of the Service. Where we offer a formal service-level agreement, its specific terms will control over this general statement.
9. Third-Party Integrations
The Service may interoperate with third-party products and services (such as calendars, CRMs, and telephony providers). Your use of those products is governed by their own terms and privacy policies, and we are not responsible for their availability, accuracy, or practices.
10. Intellectual Property
The Service, including its software, models, designs, and trademarks, is owned by AutomateNexus Voice and its licensors and is protected by intellectual property laws. Except for the rights expressly granted to you, we reserve all rights in and to the Service.
11. Disclaimers & Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to defend, indemnify, and hold harmless AutomateNexus Voice and its officers, employees, and agents from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your Customer Data, or your violation of these Terms or applicable law — including any calling, recording, or consent laws.
13. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, fail to pay fees, or use the Service in a way that creates legal or security risk.
Upon termination, your right to use the Service ends, and we may delete your Customer Data in accordance with our retention practices and applicable law.
14. Governing Law
These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws principles. You agree that the state and federal courts located in Washington will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, subject to any applicable mandatory consumer protections.
15. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
